The Privacy Policy

  1. Introduction

    1. Definitions of terms and phrases, of a legal nature or otherwise, employed within The Privacy Policy ("this policy") are detailed in the Glossary of Terms and Phrases Document. The Glossary of Terms and Phrases Document exists to facilitate the interpretation of this document in the way that OpenStrategies Ltd. ("OSL") originally intended.
    2. OSL requires you to provide, voluntarily and willingly, personal information as well other information necessary for the advancement of those OpenStrategies that you have subscribed to. This will occur upon registration and during use of the OpenStrategies Ltd. website ("the website"). The collection and handling of this information is dealt with under this policy, the OSL policy on the Handling and Protection of Personal Data which is set out in the Terms of Use Document, and in accordance with the Privacy Act 1993.
    3. Should any conflict exist between this policy or the Handling and Protection of Personal Data policy, and the Privacy Act 1993, the Privacy Act 1993 shall take precedence.
    4. OSL is an agency for the purpose of the Privacy Act 1993.
  2. The Collection of User Information by OSL

    1. Information relating to you will be collected from you in the following ways:
      1. Personal information is collected when registering with the website. This allows the creation of an account necessary for accessing and participating in the OpenStrategies hosted on the website.
      2. Information submitted by you to an OpenStrategy® is collected upon submission.
      3. Anonymous usage information collected during usage of the website.
  3. The Use of User Information by OSL

    1. OSL will use information collected from you in the following ways:
      1. Information collected by the web server and from application logs will be used for determining usage patterns and for determining errors.
      2. OSL will use personal information and aggregations of anonymous information concerning usage of the website, provided voluntarily and willingly by you, to help enhance the quality of the website, to provide personalised elements on the website, and to better prepare future website content.
      3. Your IP address will be used to diagnose problems with the web server, to administer the website and to provide broad demographic information, such as identifying countries of origin. Your IP address will be linked to personally identifiable information.
      4. Your contact details will be used by OSL to contact you, should OSL deem this necessary.
      5. Your contact details will be used to produce user directories of registered users participating in each OpenStrategy®. These user directories are localised to each OpenStrategy. These user directories will be made available to all registered users participating in the related OpenStrategy. Depending on the confidentiality setting assigned to an OpenStrategy by its lead stakeholder at its inception, these user directories may be available to registered users of the website who are not currently participating in the related OpenStrategy.
      6. Information submitted by you to an OpenStrategy will be routinely disclosed by OSL to those registered users participating in that OpenStrategy. The extent to which submitted information is disclosed to registered users outside that OpenStrategy is dependant on the confidentiality setting assigned, at its inception and by its lead stakeholder, on the OpenStrategy's Configuration Sheet.
  4. The Use of User Information by Other Parties

    1. Personal and submitted information provided by you to OSL, either by registration with the website or participation in an OpenStrategy that you have subscribed to, or by any other means, will be used by other parties. Generally these other parties will be registered users, however should some circumstance arise, as outlined in clause seven (7) of this document, this information will be used by a third party. The way in which such information is used by some other party is outside the control of OSL. Registered users have agreed to be bound by the Terms and Conditions Document and its related documents. It is generally expected that they will use this information in a fashion consistent with the letter and spirit of the Terms and Conditions Document and its related documents, as well as in a fashion consistent with the letter and spirit of the OpenStrategy from which submitted information has been sourced. OSL endeavours to ensure that all registered users conduct themselves appropriately, and, at it's discretion, will take action against those users who do not. However, OSL has no control over third party use of such information, regardless of whether that third party has obtained such information through the appropriate channels (see clause seven (7) of this document) or otherwise. OSL will, at its discretion, take action against third parties who obtain and/or use such information, and, as outlined in the Terms and Conditions Document, intends to ensure that neither occurs. However, as stated in the Terms and Conditions Document, OSL cannot and will not be liable in any fashion, should any misuse of such information by any party occur.
  5. The Storage of Personal Information Collected by OpenStrategies Ltd.

    1. The agency collecting this information is OpenStrategies Ltd., PO Box 22062 Christchurch, New Zealand..
    2. Personal information such as your IP number, password and other personal details such as your contact details are stored in a database. Your entry within the database can only be accessed by entering your Username and Password. Your Username will be stored in a session cookie while you browse the website. This session cookie will also contain a unique string consisting of a random alphanumeric combination, thirty two (32) characters long. This unique string will be used by the website to identify your computer within the OSL database. The Username stored in the cookie will provide a service of convenience to you by filling out your username within the login form on the website. The unique string allows continuity between pages browsed by you during a session on the website; this is necessary to ensure that you are provided with the appropriate page, given your request and your identity. Be aware that OSL reserves the right to alter any aspect of this method, or the method in its entirety, at any time.
  6. The Leasing, Selling or Lending of Personal Information to Third Parties

    1. OSL will not sell, trade, lend or exchange its customer database, the user directories that accompany each OpenStrategy, or any information collected from or about you or any other user of the website, to any party. OSL does, in specific circumstances, reserve the right to share personal information relating to individual users, as explicitly stated in clause seven (7) of this document.
  7. Circumstances Under Which Personal Information will be Shared with a Third Party

    1. You accept that OSL reserves the right to share your personal information with a third party in certain and specific situations. These are as follows:
      1. OSL is served with a warrant;
      2. OSL is served with a subpoena;
      3. You, or your account, are found to have posted content that directly or indirectly threatens the safety of a person (or a group of people), are in contempt of court, encourage illegal activity, violate a New Zealand law or statute, or state the intention to do something illegal;
      4. A requirement exists ordering that OSL disclose such private information in order to comply with an applicable law or regulation, or with a court or an administrative order;
      5. You subscribe to an OpenStrategy thereby allowing OSL to disclose your contact details to those users subscribed to that OpenStrategy via that OpenStrategy's user directory. Furthermore, all information submitted by you to an OpenStrategy will also be routinely disclosed to all other users subscribed to that OpenStrategy. This disclosure may extend to all users registered on the website depending on the level of confidentiality assigned, at that OpenStrategy's inception and by its Lead Stakeholder, through that OpenStrategy's Configuration Sheet. By subscribing to an OpenStrategy, you accept the above disclosure.
    2. OSL will contact you in accordance with clause sixteen (16) of the Terms and Conditions Document, should any of the above situations arise.
