The Copyright Notice

1. Introduction

   Definitions of terms and phrases, of a legal nature or otherwise, employed within The Copyright Notice ("this document") are provided in the Glossary of Terms and Phrases Document. These definitions are provided to facilitate the interpretation of the document in the way that OSL originally intended.

2. Copyright Law as it Applies in this Document
   1. You acknowledge and agree that the Service provided by OpenStrategies Ltd. ("OSL") via the OpenStrategies Ltd. website ("the website") contains proprietary and confidential information and that all content and intellectual property described, displayed, or otherwise present, on the website is protected by all the appropriate copyright, trade mark, and other intellectual property laws and treaties in New Zealand and under the appropriate international conventions and similar laws.
   2. You are authorised to view, copy and print the content found on the website providing that you agree and adhere to the following set of conditions, and that you procure the agreement to adhere to the following set of conditions from any other party to whom you pass on any content or intellectual property gained from the website:
      1. You agree to use content or intellectual property from the website for no other purpose than for your own information, research, study, or for assisting your participation in an OpenStrategy to which you have subscribed, and from which said information has been viewed, copied or printed.
      2. You agree not to modify, or exploit in any way (such as using textual or graphical content out of context), any content or intellectual property on the website for any purpose unless such a purpose is consistent with the spirit and letter of the OpenStrategy^® to which said content or intellectual property has been submitted.
      3. You agree not to reproduce, publish or sell any content and intellectual property on the website without the express consent of the author.
      4. You agree not to reverse engineer any software made available on this site, or any software provided by some other means that is required to use the service provided by OSL via the website.
3. Trade Marks and their Usage
   • You recognise that this site contains valuable trade marks that have been registered by OSL, its partners and subsidiaries, and by other entities.
   • You agree that nothing on the website can be interpreted as granting, by implication or otherwise, any license or right to use any trade mark displayed on the website.
   • You agree that only OSL and its licensees may use the OSL trade marks present on the website for the purpose of advertising or marketing. As such, you may not use an OSL trade mark in any way that would imply the endorsement, sponsorship or affiliation with a third party product unless explicitly permitted by OSL.
   • You agree not to imitate in any way any trade marks present on the website unless you are the owner of the trade mark that you are imitating, or you have been explicitly granted the license or right to do so by the owner of such a trade mark.
   • Should OSL choose to employ a trade mark from some other company or piece of software, this is done so under license from that company or from the developer of that software, and these trade marks are the property of their respective owners. The use of these trade marks on the website does not give you any rights to the use of such a trade mark, implied or otherwise.
4. The Boxes and Lines Diagram

   You expressly recognise and accept that the 'Boxes and Lines' diagram used on the website, in all its incarnations (including but not limited to the 'Item Map' sub-diagram), is the intellectual property of OSL, and is protected by any and all relevant copyright and intellectual property laws. This includes but is not limited to all individually recognisable aspects of its layout, organisation and design.

5. Ownership of Submitted Content

   Any content or intellectual property described, displayed, or otherwise present, on the website may be the subject of other intellectual property rights reserved by OSL or by the respective owner of such content or intellectual property. Nothing contained on the website shall be construed as conferring any license or right under any OSL or third party copyright. Any rights not expressly granted in the website are reserved.

   Any content that you transmit or post to the website will be considered non-confidential within the OpenStrategy that it was posted to, depending on the level of confidentiality assigned to that OpenStrategy by its lead stakeholder at its inception. Such content may also be non-confidential outside that Openstrategy. This means that such content is able to be viewed by any registered user of the website.

   You agree that any content submitted by you, except where explicitly noted, issues a non-exclusive, time unlimited, license to OSL to use as per OSL's discretion. OSL reserves the right to copy, disclose, distribute, incorporate, and otherwise use submitted content free of charge, and in any manner and in any medium, forever and throughout the world.

   Any content submitted by you or any other registered user to an OpenStrategy, is the property of the submitting user and they are considered the author of that work for the purpose of the law, unless explicitly stated. Such content is protected by all relevant copyright and intellectual property laws.

6. Software Used Under License by OpenStrategies Ltd.

   You expressly understand and accept that any pieces of software, whether freeware or otherwise, employed in the creation and ongoing maintenance of the website are the property of their respective owners and as such are protected by the appropriate laws. A list of the aforementioned software, its proprietors and the licenses under which said software is used by OSL, is available under controlled conditions only, subject to approval by OSL.
